Rules for posting opinions

ENTRY

Terms written with a capital letter in these Regulations (unless defined separately) have the meaning given to them in the Website Regulations.

RULES AND CONDITIONS FOR POSTING OPINIONS ON THE WEBSITE

  1. The Customer who is a registered user of the Website (who has an individual account on the Website) is entitled to post opinions regarding the Products offered on the Website (hereinafter: "Opinion" or "Opinions").
  2. Posting an Opinion is possible after reading and accepting these Opinion Regulations.
  3. Opinions are posted by the Customer under a nickname of his choice. The nickname (nickname) cannot violate the rights of third parties (including copyrights, derivative rights or personal rights) or good practices. If the Seller finds that the nickname (nickname) chosen by the Customer is inconsistent with these Opinion Regulations, he has the right to remove it.
  4. Opinions are posted in a descriptive and graphic form (by awarding the number of stars chosen by the Customer). Based on Customer Opinions, a given Product will have a specific number of stars. The number of stars for a Product is calculated based on the arithmetic average of the number of stars left in Customer Reviews for a given Product.
  5. Opinions can only be posted in Polish.
  6. By posting Opinions on the Website, the Customer ensures and declares that the Opinions:
    1. are the result of his own intellectual work and he is their sole author who has all rights to them (including copyright and derivative rights);
    2. are true, legal, do not violate the rights of third parties or good customs or principles of social coexistence;
    3. do not violate the provisions of these Opinion Regulations.
  7. The Customer agrees and confirms that he will not post Reviews:
    1. knowingly false, inaccurate or misleading;
    2. violating the rights of third parties, including copyright or industrial property rights, trade secrets, trade secrets, rights of publication or privacy;
    3. containing contact details, including in particular names and surnames, telephone numbers, address details or other contact details (e.g. e-mail addresses);
    4. violating any provisions of law, good customs or principles of social coexistence; e) that is discriminatory, defamatory, slanderous, unlawfully intimidating or harassing any person (entity);
    5. not relating in whole or in part to the reviewed Products;
    6. for which the Client received remuneration or other benefits;
    7. containing computer viruses or other potentially harmful programs or files;
    8. containing references or links to other products, third parties or portals.
  8. If the Customer wants to delete the Opinion posted by him on the Website, he may contact the Seller for this purpose using the contact details provided here.

COPYRIGHT

  1. Upon posting the Opinion on the Website, the Customer grants the Seller a non-exclusive, free of charge, territorially and temporally unlimited license for the Seller to use the Opinion in the following fields of use:
    1. disseminating Opinions by making them publicly available in such a way that everyone can have access to them at a place and time of their choosing, including on the Internet, mobile networks and other networks of this type or operating similarly;
    2. recording and reproduction using any technique, as well as partial or total preservation and reproduction in plastic, photographic, audiovisual recording and reproduction, in the form of digital or magnetic recording, regardless of the standard, system or format, entering into computer memory;
    3. use in whole or in part (including for the purposes of promotion and advertising conducted by the Seller), copying, changing, deleting in whole or in part, adapting, translating, creating derivative works and implementing them using any technology.
  2. The Client consents to the disposal and use of the Opinion studies (dependent right) and grants the right to authorize the exercise of dependent copyrights.
  3. If third parties submit any claims against the publication of Opinions, the Customer undertakes to take all possible factual and legal actions to protect the Seller against such claims. In addition, the Customer will be obliged to repair any damage incurred by the Seller related to the publication of the Opinion by a given Customer.

 

FINAL PROVISIONS

  1. The Seller is not responsible for Opinions posted by Customers on the Website to the fullest extent permitted by applicable law.
  2. In matters not regulated in these Opinion Regulations, the provisions of the Website Regulations apply. In the event of any discrepancies between these Opinion Regulations and the Website Regulations, the provisions of the Opinion Regulations shall prevail.
  3. Information on data processing, including information on the processing of personal data in cookies and other similar internet technologies, can be found in the Privacy Policy.
  4. The Seller may change the content of these Feedback Regulations only for an important reason. The following are considered important reasons:
    1. the need to adapt the Opinion Regulations to generally applicable legal provisions and judgments, decisions, resolutions, guidelines, interpretations, recommendations or orders of public authorities;
    2. change of the company name, legal form, identification numbers, address or contact details of the Seller;
    3. changing the scope and type of services provided, including in particular the introduction of new services provided electronically or changes to the existing functionalities of the Website and withdrawal of certain functionalities (including those related to posting Opinions);
    4. improving or changing the customer service process;
    5. change in technical conditions for the provision of Electronic Services;
    6. the need to introduce additional or change existing security measures, as well as to counteract abuses of law;
    7. changing business processes and business concepts;
    8. the need to change hyperlinks or links included in the Regulations of Opinions, as well as purely editorial changes aimed at facilitating the clarity of the text, removing ambiguities and errors and clerical errors that would possibly appear in the Regulations of Opinions.
